The situation unfolded when Judge Arthur Engoron issued a warning against Trump for not taking down a social media post that was deemed "untrue and disparaging" toward a court clerk. Judge Engoron voiced his exasperation, stating, "I ordered him to remove the post immediately, and he said he did take it down." However, it became apparent that the contentious post remained accessible on a website, in direct violation of the gag order. Engoron emphasized the seriousness of this breach, noting that failure to comply with the court's directives would lead to significant sanctions, which could include fines or even imprisonment for Trump.

In his post, Trump referred to the clerk as "Schumer's girlfriend." Trump's lawyer, Christopher Kise, contended that the post had been removed from social media but was inadvertently left on Trump's campaign website, a situation for which he apologized.
